Participation Waiver IntroductionThis Participation Agreement and Release ("Agreement") is a legally binding document between Wellness Defined Inc. ("Wellness Defined," "we," or "our") and the participant ("I" or "me"). The purpose of this Agreement is to inform me of potential risks involved in participating in Wellness Defined’s activities, including classes, workshops, and retreats, and to release Wellness Defined from liability to the fullest extent permitted by law. By completing and signing this Agreement, I acknowledge that I have read, understood, and voluntarily agree to all terms below.1. Scope of Activities I understand that Wellness Defined offers a range of wellness-based activities that may include, but are not limited to: Yoga, Pilates, stretching, fitness, breathwork, or meditation sessions Wellness, mindfulness, and personal development workshops Nutrition, health, and coaching programs Outdoor activities including walking, hiking, or nature-based sessions Overnight or multi-day retreats, which may include travel, accommodation, group meals, and shared facilities I understand that all of these are collectively referred to in this Agreement as “Activities.” 2. Acknowledgement of Risk I acknowledge that participation in Activities involves inherent and unavoidable risks, including but not limited to: Slips, falls, or collisions Physical exertion resulting in muscle strain, injury, or fatigue Allergic reactions or food sensitivities Exposure to outdoor elements such as uneven terrain, insects, or changing weather Emotional discomfort or psychological stress arising from personal development exercises I understand that Wellness Defined cannot guarantee my safety and that accidents or injuries can occur even under the safest conditions. Risk Acceptance(Required) I understand and accept that participation carries inherent risks, and I choose to participate voluntarily.Initial to confirm(Required)3. Health and Fitness Declaration I confirm that I am in good physical and mental health and that I do not have any medical condition, injury, or disability that would make participation in any Activities unsafe. I acknowledge that: I am responsible for consulting my healthcare provider before participating. I will immediately notify Wellness Defined instructors of any pain, discomfort, or medical concerns. I will not participate under the influence of alcohol, drugs, or any substance that could impair my judgment or ability to participate safely. Health Declaration(Required) I confirm I am medically fit to participate and will take responsibility for my own physical and emotional well-being.Initial to confirm(Required)4. Release of Liability and Waiver of Claims In consideration of being permitted to participate in Activities provided by Wellness Defined, I hereby: WAIVE, RELEASE, AND FOREVER DISCHARGE Wellness Defined Inc., its owners, instructors, facilitators, staff, agents, contractors, volunteers, affiliates, insurers, successors, and assigns (collectively “the Released Parties”) from any and all liability, claims, demands, or actions arising from my participation in Activities, including claims arising from the negligence of the Released Parties, except where caused by reckless or intentional conduct. ASSUME FULL RESPONSIBILITY for any loss, damage, injury, illness, or death I may suffer as a result of participating. INDEMNIFY AND HOLD HARMLESS the Released Parties against any loss or damage they may suffer as a result of my actions during participation. Personal Property and ConductI acknowledge that Wellness Defined is not responsible for lost, stolen, or damaged personal property during Activities. I agree to treat other participants and instructors with respect, maintain confidentiality during group discussions, and behave in a manner that ensures the safety and comfort of others. Wellness Defined reserves the right to remove any participant acting inappropriately or unsafely without refund.6. Legal Terms and Governing Law This Agreement shall be governed by and interpreted according to the laws of the Province of Alberta and the laws of Canada applicable therein. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. I have read, understood, and voluntarily agreed to the terms and conditions contained in this Agreement. This release shall be binding upon me, my heirs, executors, administrators, and assigns.
